Submission and Pre-Examination Processing

Once you submit your patent application to the USPTO, the application will undergo initial pre-examination processing. During this stage, the USPTO checks that the proper filing fee has been paid and that all required documents, such as the specification, drawings, and claims, are included. The application is reviewed to ensure that it is ready for formal examination.
This stage is an administrative process, ensuring that everything is in order before the application is assigned to a Patent Examiner.

Assignment to a Patent Examiner

After the application passes initial processing, it will be assigned to a Patent Examiner who has a technical background relevant to the field of the proposed invention. The Patent Examiner’s role is to evaluate the application to determine whether the invention meets the requirements for patentability.
The Examiner will conduct their own search to review prior art, which includes previously issued patents, published patent applications, printed publications, and other public disclosures. The goal of this search is to assess whether the proposed invention is useful, novel, and non-obvious in light of existing inventions and knowledge.

Initial Examination and Office Actions

It’s common for patent applications to receive an Office Action following the initial examination. The Office Action is an official communication from the Patent Examiner detailing any rejections or objections to the application. The most common grounds for rejection include:

• Lack of novelty: The Examiner believes that the invention is not new, as it has already been disclosed by prior art.
• Obviousness: The Examiner believes that the invention is an obvious modification or combination of existing inventions, making it unpatentable.

This stage is often where the majority of patent applications are initially rejected. The rejection doesn’t mean that the invention is not patentable; rather, it indicates that the Examiner has found potential issues with the application’s claims in light of the existing prior art.

Response to Office Actions

After receiving an Office Action, the applicant (with the help of their patent attorney) has an opportunity to respond. The response can include several different strategies:

• Amend the claims: The applicant may amend the claims of the invention to clarify the differences between the proposed invention and the prior art cited by the Examiner. By adjusting the wording or scope of the claims, the applicant can attempt to make the invention novel and non-obvious.
• Argument and Explanation: The applicant can also argue against the Examiner’s rejections, providing reasoning and evidence that demonstrates how the invention is distinct from the prior art.

This back-and-forth communication between the applicant and the Patent Examiner is known as prosecution and is often a lengthy process involving multiple rounds of amendments and responses.

Notice of Allowance or Final Rejection

After the response and amendment process, there are two possible outcomes:

• Notice of Allowance: If the Patent Examiner is satisfied with the amendments or arguments provided, they will issue a Notice of Allowance, indicating that the application has been approved and will be granted a patent. The applicant will then need to pay an issue fee before the patent is officially granted.
• Final Rejection: If the Examiner is not convinced by the response and determines that the application still does not meet the patentability requirements, they may issue a Final Rejection. At this point, the applicant has a few options:
  • File a continuation: If the applicant still believes the invention is patentable, they can file a continuation application to pursue further prosecution based on the same disclosure.
  • Request an appeal: If the applicant disagrees with the Examiner’s final decision, they can initiate an appeal to the Patent Trial and Appeal Board (PTAB) to challenge the rejection.

Appeal Process

If a Final Rejection is issued, and the applicant believes the invention is still patentable, they may choose to appeal the decision to the Patent Trial and Appeal Board (PTAB). The PTAB will review the Examiner’s decision and issue a ruling on the appeal.

If the PTAB rules in favor of the applicant, the application will be returned to the Examiner with instructions to allow the application. If the PTAB upholds the Examiner’s rejection, the applicant may need to consider other options, such as filing a continuation application or abandoning the application.
